General Terms and Conditions, as of October 01, 2016

§ 1 Scope

The following general terms and conditions govern the sale of goods that HUMANTECHNIK GmbH offers on its website “www.humantechnik.com”.

By submitting an order, the buyer agrees to the exclusive application of these General Terms and Conditions.

§ 2 Conclusion of contract

By placing an order, the buyer acknowledges the respective prices and the description of the items in his “order list”.

The contract language is exclusively German.

Selection of goods and ordering include the following steps:

a) Watch list and selection:
The respective items are selected by clicking on the button to the left of the item name. The system then lists the relevant items in the “watch list”.

b) Checking and editing the watch list: 
By clicking on the “View watch list” button in the green menu field on the right edge of the screen, the buyer can view, check and, if necessary, correct the contents of the watch list.

The watch list can be saved and edited over a longer period of time. The content can also be deleted with a mouse click.

c) Inquiries and orders:
By clicking the “Send as request” button in the open watch list, the user triggers a request to Humantechnik.

By clicking on the “Send as order” button in the open shopping list, the buyer places the order bindingly.

HUMANTECHNIK GmbH confirms receipt of the order by email to the buyer. This confirmation of receipt can also take place automatically if necessary.

HUMANTECHNIK GmbH stores the contract data for the processing of the process and undertakes to make this data accessible to the buyer at any time (see also data protection declaration).

d) Billing and delivery address: 
The address data stored in the customer account applies as the billing and delivery address for orders.

e) Method of payment:
Acceptance of these general terms and conditions is required for each order.

Payment for orders from the website www.humantechnik.com takes place exclusively after invoicing.

Ordering via the website is only possible for registered business partners. The prices listed then also take into account the respective customer discount level.

Discount level II applies if the net order value exceeds €400.00. The prices listed under discount level I apply.

Before sending the contents of the watch list as an order, you have the opportunity to check all information and correct it if necessary.

§ 3 Retention of title

The delivered goods remain the property of HUMANTECHNIK GmbH until full payment has been made.

§ 4 Prices

The item prices listed in the account holder's individual watch list at the time of the order are binding.

§ 5 Shipping costs

Up to a net order value of 280 ex works Weil am Rhein: freight forwarded

Over a net order value of 280 ex works Weil am Rhein: free delivery.

If the customer requests deviations from standard shipping - for example from express and delivery options - HUMANTECHNIK GmbH may charge shipping costs that deviate from the standard. These will be shown separately on the invoice.

§ 6 Delivery Conditions

Normally, HUMANTECHNIK GmbH ships the goods within 2 working days of receipt of the order.

§ 7 Terms of Payment

Payment is made exclusively after invoicing. Unless otherwise agreed individually, payment terms are 8 days 3% discount / 30 days: net.

§ 8 Right of return

Up to 2 weeks after the invoice has been issued, all devices will be taken back at the calculated purchase price, less a processing fee of €8.00 net. Requirement: Franked return shipping, always in undamaged original packaging!

§ 9 Guarantee / Warranty

We give end customers a guarantee of 24 months (excluding batteries and accumulators).

Requirement for warranty service: Completely completed and stamped warranty card upon sale to the end customer

The warranty includes free repairs and free return shipping.

The guarantee is void in the event of damage caused by improper handling and in the event of repair attempts by persons not authorized by Humantechnik (violation of the device seal).

A shortening of limitation periods does not apply to claims for damages that have arisen due to injury to life, body or health.

Furthermore, it does not apply

  • for claims for damages that are raised due to a breach of essential contractual obligations.
  • for claims for damages that are based on an intentional or grossly negligent breach of duty by HUMANTECHNIK GmbH, its legal representatives or vicarious agents.

§ 10 Applicable law

The law of the Federal Republic of Germany applies exclusively to the contractual relationships between HUMANTECHNIK GmbH and the buyer.

§ 11 Place of performance, place of jurisdiction, partial invalidity

The place of performance is the headquarters of HUMANTECHNIK GmbH.

The exclusive place of jurisdiction for all current and future claims arising from the business relationship with merchants, including bills of exchange and check claims, is the registered office of HUMANTECHNIK GmbH.

The same place of jurisdiction applies if the client does not have a general place of jurisdiction in Germany, moves his place of residence or usual place of residence abroad after conclusion of the contract or if his place of residence or place of residence is not known at the time the action is filed.

Should a provision in these terms and conditions or a provision within the framework of other agreements be or become invalid, this will not affect the effectiveness of all other provisions or agreements.
